Welcome to the Techie Australia website. These Terms of Service ("Terms") govern your use of the website at techie.org.au and all related services operated by Techie Australia Limited (ABN 37 678 188 308), a registered charity with the Australian Charities and Not-for-profits Commission (ACNC).
By accessing or using our website, you agree to be bound by these Terms. If you do not agree, please do not use our website.
1. About Techie Australia
Techie Australia is a registered charity that recovers, refurbishes, and redistributes technology to individuals and communities in need. We also operate volunteer programs, educational initiatives, and accept financial donations to support our mission of bridging the digital divide.
2. Eligibility
You must be at least 16 years of age to create an account or use our services. If you are under 18, you'll need permission from a parent or guardian. By creating an account or using our services, you confirm that you meet these requirements.
3. Accounts
Certain features of our website require you to create an account. When creating an account, you agree to:
- Provide accurate, current, and complete information
- Keep your login credentials secure and not share them with others
- Notify us immediately of any unauthorised access to your account
- Accept responsibility for all activity that occurs under your account
We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.
4. Device donations
4.1 Donating a device
When you donate a device to Techie Australia, you acknowledge that:
- You are the legal owner of the device or are authorised to donate it
- The device is legally yours to give away, with no outstanding debts, leases, or legal claims attached to it
- You have removed all personal data from the device prior to donation, or you authorise us to securely wipe the device in accordance with our Data Sanitisation Policy
- Ownership of the device transfers to Techie Australia upon acceptance of the donation
- Donated devices may be refurbished and redistributed, recycled responsibly, or used for parts at our discretion
4.2 No guarantee of acceptance
We reserve the right to decline any device donation. Not all devices can be refurbished, and acceptance is subject to our current capacity and needs.
5. Financial donations
Financial donations are processed securely through Stripe. By making a donation:
- You confirm you are authorised to use the payment method provided
- Donations are generally non-refundable as they support our charitable mission. If you believe you made a donation in error, contact us at hello@techie.org.au within 14 days. Refund requests are assessed on a case-by-case basis in accordance with Australian Consumer Law
- Tax-deductible receipts will be issued where applicable in accordance with ATO requirements
- The optional "cover processing fees" amount is an additional voluntary contribution
6. Applications for support
Individuals and organisations may apply to receive technology through our programs. Submitting an application does not guarantee you will receive a device. All applications are assessed based on our eligibility criteria, available inventory, and program guidelines. Decisions are made at our sole discretion and are final.
7. Volunteering
Volunteer applications are subject to review and approval. By volunteering with Techie Australia, you agree to:
- Act in accordance with our values, policies, and any applicable codes of conduct
- Treat all individuals with respect and dignity
- Maintain the confidentiality of any personal information you may access
- Comply with all relevant workplace health and safety requirements
Volunteers working directly with children or vulnerable people will be required to hold a valid Working with Children Check or National Police Check. We'll let you know during the application process if your role requires this.
8. Organisation accounts
Organisations that register on our platform represent and warrant that:
- The person creating the account is authorised to act on behalf of the organisation
- The organisation details provided (including ABN) are accurate
- Devices received through our programs will be used for the stated purpose and will not be sold or resold
9. Acceptable use
You agree not to use our website or services to:
- Submit false, misleading, or fraudulent information
- Impersonate another person or organisation
- Interfere with the operation of the website or attempt to gain unauthorised access
- Use automated tools to scrape, harvest, or collect data from our website
- Engage in any activity that is unlawful or harmful to Techie Australia or its users
10. Intellectual property
All content on this website, including text, graphics, logos, images, and software, is the property of Techie Australia Limited or its licensors and is protected by Australian and international intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our prior written consent.
11. Limitation of liability
To the maximum extent permitted by law, Techie Australia Limited, its directors, officers, employees, and volunteers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to:
- Your use of (or inability to use) our website or services
- Any device donated to or received from us
- Any errors, inaccuracies, or omissions in our content
- Unauthorised access to or alteration of your data
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law.
12. Disclaimer of warranties
Our website and services are provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, regarding the operation of the website, the accuracy of the content, or the condition of refurbished devices. Refurbished devices are provided without warranty unless expressly stated otherwise.
13. Indemnification
You agree to indemnify and hold harmless Techie Australia Limited and its directors, officers, employees, and volunteers from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of our website, your violation of these Terms, or your violation of any rights of a third party.
14. Privacy
Your use of our website is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.
15. Changes to these Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the website after changes are posted constitutes your acceptance of the revised Terms.
